Product Guarantee

As concerned with the Real Decreto Legislativo 1/2007, the consumer goods must be in conformity with the contract of sale (article 114).

Goods are deemed to be in conformity with the contract if, at the moment of delivery to the consumer:

  • They comply with the description given by the seller and possess the qualities of the product which the seller has held out to the consumer as a sample or model;

  • They are fit for the purposes for which goods of the same type are normally used;

  • They are fit for any particular purpose for which the consumer requires them and which was made known to the seller at the time of conclusion of the contract, and accepted by the seller;

  • Their quality and performance are satisfactory, given the nature of the goods and taking into account the public statements made about them by the seller, the producer or his representative.

Xviolins guarantees the quality of the products sold, within the terms established by the Real Decreto Legislativo 1/2007, articles 114 and following, and for a period of two years from the date of delivery.

Consequently, Xviolins will be responsible for faults which may arise within this period. In any case, it is necessary for the buyer to officially inform the seller that he is not satisfied within a deadline of 6 months of the time he realises he is not satisfied or discovers the fault.

It does not include damage caused by negligence, physical knocks, improper use or manipulation, incorrect electrical current, incorrect installation that is not performed by our authorised technical service, when applicable, or regular wear or tear due to normal use.

In the case of problems that are covered by the guarantee, items will be repaired, replaced, discounted or returned, according to the terms established by law.

The guarantee will no longer be valid if any of the following occur:

  • If any information of the guarantee itself or the sales receipt is modified, altered or changed.

  • If the item's serial number is tampered with or changed, or if the item is repaired or modified without the knowledge of our technical service.

  • If you wish to make use of your product guarantee within the legally set period of two years following product delivery, you must present your purchase receipt. Once this period has elapsed, and should the purchased product have an additional manufacturer's guarantee, the aforementioned guarantee must be presented together with the purchase receipt and the completed guarantee certificate.

Any lack of conformity becoming apparent within six months of delivery will be presumed to have existed at the time of delivery, unless:

  • Proof to the contrary is furnished;

  • This presumption is incompatible with the nature of the goods or the nature of the lack of conformity.

When a lack of conformity is notified to the seller, the consumer will be entitled to ask:

  • For the goods to be repaired or replaced free of charge within a reasonable period and without major inconvenience to the consumer;

  • For an appropriate reduction to be made to the price, or for the contract to be rescinded, if repair or replacement is impossible or disproportionate, or if the seller has not remedied the shortcoming within a reasonable period or without major inconvenience to the consumer.

The contract cannot be rescinded if the lack of conformity is minor.

Commercial guarantee

Commercial guarantee is an additional guarantee of the product which the seller or manufacturer may offer and which voluntarily extends the minimum period in the conditions that they see fit.

 

Remember that Xviolins will not be responsible for faults caused by improper use, manipulation, incorrect electrical current or incorrect installation that is not performed by a professional. The guarantee will not be applicable in case of external factors besides the normal use of the product, like rise or drop in voltage, the use of unsuitable or prohibited accessories by the manufacturers, water, fire or abusive or incorrect use by the buyer or third people not authorized by manufacturers.

In case of breackdown and consequently repair of the products, the buyer must attend exclusively to the SATs (recognized and authorised by manufacturers).

The guarantee only applies to the contract's titular and only the titular may demand it. Xviolins will not be responsible for demands of third people not included in the purchase receipt.
